1. Overview

This Acceptable Use Policy ("AUP") sets forth the terms and conditions for acceptable use of the Student Task Management System ("Service") operated by Vandium Ventures LLC. By accessing and using the Service, you agree to comply with this policy and all applicable laws and regulations.

This policy applies to all users, including students, parents/guardians, administrators, and any other users of the Service. Violation of this policy may result in suspension or termination of your account and access to the Service.

2. Permitted Use

The Service is provided for legitimate educational purposes only. Permitted uses include:

For Students:

  • Creating, viewing, and managing personal academic tasks and assignments
  • Tracking test and quiz schedules and study progress
  • Receiving task reminders and academic notifications
  • Communicating with guardians through the Service messaging system
  • Receiving feedback on engagement and academic performance
  • Accessing your own educational records and historical data

For Guardians/Parents:

  • Creating and managing family accounts and student profiles
  • Assigning tasks to students and monitoring task completion
  • Viewing student activity reports and engagement scores
  • Receiving notifications about student academic progress
  • Communicating with students through the Service messaging system
  • Managing family notification preferences and SMS opt-ins

For Administrators:

  • Creating and managing user accounts (with proper authorization)
  • Configuring school schedules and class periods
  • Managing system settings and administrative functions
  • Viewing system performance and usage analytics

3. Prohibited Uses

You agree NOT to use the Service for any of the following purposes:

3.1 Illegal Activities

  • Violating any federal, state, or local law or regulation
  • Engaging in fraud, forgery, or misrepresentation
  • Harassing, threatening, defaming, or abusing any person
  • Transmitting obscene, indecent, or sexually explicit content involving minors
  • Exploiting or endangering children in any way
  • Extortion, blackmail, or coercion

3.2 Unauthorized Access

  • Attempting to access accounts that don't belong to you
  • Sharing login credentials with unauthorized persons
  • Attempting to bypass security measures or authentication systems
  • Accessing another user's account without permission
  • Attempting to gain unauthorized access to system infrastructure
  • Hacking, reverse engineering, or decompiling the Service

3.3 Intellectual Property Violations

  • Uploading, posting, or transmitting copyrighted material without authorization
  • Plagiarizing or claiming credit for work not your own
  • Reproducing or distributing proprietary information from the Service
  • Violating any trademark, patent, or intellectual property rights

3.4 Harmful Content & Behavior

  • Posting or transmitting hate speech, racist content, or discriminatory material
  • Cyberbullying, harassment, or hostile behavior toward other users
  • Spamming, flooding, or sending repetitive unwanted messages
  • Posting violent, graphic, or disturbing content
  • Creating misleading or deceptive content designed to harm others
  • Impersonating another person or entity

3.5 Technical Abuse

  • Introducing viruses, malware, worms, or other harmful code
  • Attempting denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
  • Scraping or automated collection of data without authorization
  • Excessive bandwidth consumption or resource abuse
  • Creating multiple accounts to circumvent restrictions or policies
  • Using bots, scripts, or automated tools for unauthorized purposes

3.6 Misuse of Guardian Features

  • Using the Service to harass, stalk, or threaten a student
  • Misrepresenting your relationship to a student to gain access
  • Creating fake family accounts or using false information
  • Accessing student information for purposes other than educational oversight
  • Sharing a student's private information with unauthorized third parties

3.7 Commercial & Marketing Misuse

  • Using the Service for marketing, advertising, or promotional purposes
  • Soliciting funds, donations, or selling products/services through the platform
  • Using the Service for spam or unsolicited communications
  • Reselling, sublicensing, or redistributing access to the Service

3.8 Misrepresentation

  • Providing false or misleading information during registration
  • Falsifying your age or identity
  • Misrepresenting your authority to act on behalf of another person
  • Creating accounts for minors without proper parental consent

4. Content Responsibility

4.1 User Content

You are solely responsible for any content you create, upload, post, or transmit through the Service, including tasks, assignments, messages, and comments. By posting content, you represent that:

  • You have the legal right to post the content
  • The content does not violate any laws, regulations, or third-party rights
  • The content is accurate and truthful to the best of your knowledge
  • You have obtained any necessary permissions or licenses

4.2 Content Standards

Content posted to the Service should be:

  • Respectful and appropriate for a school setting
  • Free of profanity, obscenity, or offensive language
  • Related to academic or educational purposes
  • Not intended to harm, harass, or deceive others
  • Original or properly attributed to sources

4.3 Moderation Rights

We reserve the right to review, monitor, edit, or remove any content that violates this policy or applicable laws. We may do this at our sole discretion without notice or liability.

5. Account Security & Responsibility

5.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to:

  • Use a strong, unique password
  • Never share your password with anyone
  • Immediately notify us of any unauthorized access or suspected breach
  • Log out of your account when using shared devices
  • Not store passwords in plain text or easily accessible locations

5.2 Account Responsibility

You are responsible for all activity occurring under your account, whether authorized or unauthorized. We are not responsible for:

  • Unauthorized access to your account
  • Loss or damage resulting from password compromise
  • Actions taken by third parties using your credentials

5.3 Parental Controls

Parents and guardians are responsible for supervising their children's use of the Service and ensuring compliance with this policy.

6. Data & Information Handling

6.1 Protecting Student Privacy

All users must respect the privacy and confidentiality of student information. You agree:

  • Not to share student information with unauthorized third parties
  • Not to disclose another student's academic information
  • Not to screenshot or download student data without authorization
  • To comply with FERPA, COPPA, and all applicable privacy laws

6.2 No Data Scraping

You are prohibited from:

  • Using automated tools to extract or collect data from the Service
  • Creating copies of the database or system information
  • Reverse engineering the Service or its algorithms
  • Distributing bulk downloads of Service content

6.3 Backup & Export

You may export your own data for personal backup purposes in accordance with our Privacy Policy, but redistribution of exported data is prohibited.

7. Minor Protection

The Service is designed for high school students. We take additional precautions to protect minors:

  • All users suspected to be under 18 require parental consent and supervision
  • Students cannot contact or be contacted by unknown parties through the Service
  • Messages between students and non-guardians are limited and monitored
  • No collection of unnecessary personal information from minors
  • Parental access and override controls remain active for all student accounts
ZERO TOLERANCE FOR CHILD EXPLOITATION: Any attempt to exploit, endanger, or harm a minor will result in immediate termination of all accounts, complete deletion of data, and reporting to appropriate law enforcement authorities.

8. Enforcement & Violations

8.1 Monitoring

We may monitor user activity to detect and prevent violations of this policy. Monitoring may include:

  • Reviewing messages for spam, abuse, or illegal content
  • Analyzing usage patterns for suspicious activity
  • Tracking IP addresses and device information
  • Automated detection systems for malware or attacks

8.2 Violation Response

Upon discovery of a violation, we may take any or all of the following actions:

  • Warning: Written notification of the violation and required corrective action
  • Content Removal: Removal of violating content without notice
  • Account Suspension: Temporary restriction of account access (24 hours to 30 days)
  • Account Termination: Permanent closure of the account and deletion of associated data
  • Legal Action: Referral to law enforcement for suspected criminal activity

8.3 Severity Considerations

The severity of enforcement action depends on:

  • Nature and severity of the violation
  • Frequency and pattern of violations
  • User's history with the Service
  • Intent and circumstances
  • Whether the violation involves harm to minors

8.4 Serious Violations - Immediate Termination

The following violations will result in immediate account termination without warning:

  • Child exploitation or abuse of any kind
  • Illegal activity or criminal behavior
  • Hacking or unauthorized system access
  • Distribution of malware or viruses
  • Harassment or stalking of other users
  • Impersonation of staff or fraudulent misrepresentation

9. Reporting Violations

If you witness or suspect a violation of this policy, please report it immediately:

  • Subject: "Acceptable Use Policy Violation Report"
  • Include: Specific details, user accounts involved, timestamps, and any evidence
  • Response Time: We will investigate and respond within 5 business days
Child Safety: Any suspected child exploitation should be reported to the National Center for Missing & Exploited Children (NCMEC) at CyberTipline.org or contact law enforcement immediately, in addition to reporting to us.

10. No Warranty

The Service is provided "AS IS" without any warranties or guarantees. We do not guarantee:

  • Continuous or uninterrupted access to the Service
  • Error-free operation or performance
  • Security against all forms of attack or unauthorized access
  • Permanent storage or recovery of data
  • Achievement of specific educational outcomes

11. Limitation of Liability

In no event shall Vandium Ventures LLC be liable for any damages, claims, or losses arising from your use of the Service, including:

  • Data loss or corruption
  • Service interruptions or unavailability
  • Unauthorized access to your account
  • Third-party actions or content
  • Lost profits or business interruption

12. Indemnification

You agree to indemnify and hold harmless Vandium Ventures LLC from any claims, damages, liabilities, costs, and expenses (including attorneys' fees) arising from:

  • Your use of the Service in violation of this policy
  • Content you create or post
  • Your violation of any laws or rights of third parties
  • Your violation of intellectual property rights

13. Modifications to This Policy

We may update this policy at any time. Changes become effective immediately upon posting. Continued use of the Service after changes indicates your acceptance of the updated policy. We will provide notice of material changes via email or prominent notice on the Service.
